Voisins, porteurs de projet et collectivit\u00e9s doivent en tenir compte, car certaines habitudes peuvent d\u00e9sormais co\u00fbter la recevabilit\u00e9 du recours.<\/p>\n\n\n<h2 class=\"wp-block-heading\">Le recours gracieux ne prot\u00e8ge plus<\/h2>\n\n\n<p class=\"wp-block-paragraph\">Le nouvel article L. 600-12-2 du code de l\u2019urbanisme, en vigueur depuis le 28 novembre 2025, fixe \u00e0 <strong>un mois<\/strong> le d\u00e9lai pour former un recours gracieux ou hi\u00e9rarchique contre une d\u00e9cision relative \u00e0 une autorisation d\u2019urbanisme ; le silence gard\u00e9 plus de deux mois vaut rejet. Surtout, ce recours <strong>ne proroge plus le d\u00e9lai de recours contentieux<\/strong>. Envoyer un courrier au maire en pensant \u00ab gagner du temps \u00bb expose donc \u00e0 laisser passer le d\u00e9lai pour saisir le tribunal.<\/p>\n\n\n<h2 class=\"wp-block-heading\">Refus de permis : l\u2019urgence pr\u00e9sum\u00e9e en r\u00e9f\u00e9r\u00e9<\/h2>\n\n\n<p class=\"wp-block-paragraph\">Lorsqu\u2019un refus de permis de construire, d\u2019am\u00e9nager ou de d\u00e9molir, ou une opposition \u00e0 d\u00e9claration pr\u00e9alable, est contest\u00e9 et qu\u2019un r\u00e9f\u00e9r\u00e9-suspension est engag\u00e9, le nouvel article L. 600-3-1 pr\u00e9sume la condition d\u2019urgence satisfaite, pour les r\u00e9f\u00e9r\u00e9s introduits apr\u00e8s la publication de la loi. Le porteur de projet dispose ainsi d\u2019un outil plus efficace pour obtenir rapidement un nouvel examen de sa demande.<\/p>\n\n\n<h2 class=\"wp-block-heading\">Les r\u00e9flexes \u00e0 conserver<\/h2>\n\n\n<ul class=\"wp-block-list\">\n<li>Agir vite : pour les tiers, le d\u00e9lai de recours contentieux contre un permis ou une non-opposition \u00e0 d\u00e9claration pr\u00e9alable court \u00e0 compter du premier jour d\u2019une p\u00e9riode continue de deux mois d\u2019affichage sur le terrain (article R. 600-2).<\/li>\n\n\n<li>Notifier le recours, y compris un recours gracieux, \u00e0 l\u2019auteur de la d\u00e9cision et au titulaire de l\u2019autorisation, par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception, dans les quinze jours francs, \u00e0 peine d\u2019irrecevabilit\u00e9 (article R. 600-1).<\/li>\n\n\n<li>Justifier d\u2019un int\u00e9r\u00eat \u00e0 agir : un particulier doit d\u00e9montrer que le projet est de nature \u00e0 affecter directement les conditions d\u2019occupation, d\u2019utilisation ou de jouissance du bien qu\u2019il d\u00e9tient ou occupe r\u00e9guli\u00e8rement (article L. 600-1-2).<\/li>\n<\/ul>\n\n\n<p class=\"wp-block-paragraph\">Le contentieux de l\u2019urbanisme est particuli\u00e8rement technique et ses d\u00e9lais sont stricts : un accompagnement d\u00e8s la connaissance du projet est vivement recommand\u00e9.<\/p>\n\n\n<p class=\"wp-block-paragraph\"><em>Cet article pr\u00e9sente des informations g\u00e9n\u00e9rales et ne constitue pas une consultation.
